1. Overview

These Terms of Service (“Terms”) govern your access to and use of the services provided by TMC Servers (“TMC Servers,” “we,” “our,” or “us”). By using any of our services, including free or paid hosting for Discord bots, Linux virtual machines, or websites (collectively, the “Services”), you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our Services.

By agreeing to these Terms, you also automatically agree to our Privacy Policy (the “Privacy Policy”), which describes how we collect, use, and protect your information. The Privacy Policy is incorporated by reference and forms part of these Terms.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have permission from a parent or guardian to use our Services. By registering, you affirm that all information provided is accurate and that you are not using the Services on behalf of someone else without authorization.

3. Accounts and Alternate Accounts

Each person may hold only one account.
Creating, maintaining, or using alternate accounts (multiple accounts owned or controlled by the same person) is strictly prohibited.
Violations of this rule may result in immediate and indefinite suspension of all associated accounts, regardless of whether they are free or paid.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Free vs. Paid Services

TMC Servers offers both free and paid plans.

  • Free services are provided as-is and without guarantee of uptime, performance, or continued availability.
  • TMC Servers staff reserve the right to modify, suspend, or terminate any free service at any time and for any reason, including but not limited to misuse, inactivity, excessive resource usage, or violation of these Terms.
  • Normal, compliant users will not have their free services terminated arbitrarily.
  • Paid services will be treated with greater operational stability and notice obligations, except in cases of serious violation of these Terms.

5. Acceptable Use Policy

You agree not to use the Services in any way that violates these Terms, applicable law, or the rights of others. The following activities are strictly prohibited:

A. Illegal or Harmful Use

  • Engaging in or promoting illegal activity.
  • Hosting, distributing, or linking to malicious software (malware, trojans, keyloggers, etc.).
  • Hosting or sharing copyrighted or pirated content without authorization.
  • Using TMC Servers to attack or disrupt other networks, systems, or individuals.

B. Abuse of Infrastructure

  • Running stress tests, DDoS attacks, or IP scanners.
  • Using the Services as a proxy, VPN, or for anonymization networks (e.g., Tor relays).
  • Resource abuse, including excessive CPU, RAM, storage, or bandwidth usage beyond reasonable limits.
  • Circumventing service restrictions or exploiting bugs for unfair advantage.

C. Discord and Bot Hosting Specific Rules

D. Virtual Machine and Website Hosting

  • Hosting or operating crypto mining, cracking tools, or software designed to harm others.
  • Running public game servers, unless explicitly allowed in your plan.
  • Hosting adult, pornographic, or sexually explicit content.

E. Fair Use

TMC Servers provides fair access to system resources. Any activity that interferes with the performance or stability of our infrastructure or the experience of other users may result in suspension or termination.

6. Termination and Suspension

We may suspend or terminate your account or Services immediately and without prior notice if:

  • You violate these Terms or the Acceptable Use Policy;
  • You engage in fraudulent, abusive, or harmful behavior;
  • You are found to have multiple or alternate accounts;
  • You fail to pay for a paid service (if applicable).

Termination of Services does not release you from any financial obligations incurred prior to termination.

7. Data Retention and Backups

TMC Servers does not guarantee the availability or restoration of data. You are solely responsible for maintaining your own backups. Deleted or terminated instances may be permanently removed from our systems without recovery.

8. Service Availability

While we strive for reliable uptime, TMC Servers makes no guarantees regarding the availability or uninterrupted operation of the Services. Maintenance, upgrades, or external network issues may result in temporary downtime.

9. Limitation of Liability

TMC Servers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our Services, including loss of data, revenue, or business opportunities.

Use of the Services is entirely at your own risk.

10. Changes to Terms

We may update or modify these Terms at any time, with notice provided through our website or dashboard. Continued use of the Services after any update constitutes acceptance of the revised Terms.

All legal disputes, claims, or proceedings arising out of or relating to these Terms or your use of TMC Servers shall be resolved exclusively in the courts of Hillsborough County, Tampa, Florida, United States.

You agree to submit to the personal jurisdiction of these courts.
